- What goes into a UAE final settlement?
- Salary to the last working day, encashment of any untaken annual leave, end-of-service gratuity, notice pay where notice was not served, and any lawful deductions such as an outstanding loan. Federal Decree-Law No. 33 of 2021.
- Is a final settlement calculated on basic salary or the full wage?
- Both, on different lines. Salary for the last days worked and notice pay are the full wage. The gratuity is basic only under Article 51, and a leave balance paid out because service ended is basic only under Cabinet Resolution No. 1 of 2022, Article 19 — even though leave taken during employment is paid at the full wage. Using one salary figure for all of it is the most common and most expensive error in UAE settlements.
- How long does an employer have to pay a final settlement?
- Fourteen days from the end date of the contract, under Article 53 of Federal Decree-Law No. 33 of 2021. The deadline runs from the end of the contract rather than from the last day worked, and a correct settlement paid late is still a breach.
- Does unpaid leave reduce a settlement?
- It reduces two lines and not the rest. Unpaid days in the final month reduce the salary for that month, and unpaid absence across the service is excluded from the service the gratuity is calculated on under Article 51(4). It does not change the leave balance or the notice.
- What if the employee leaves without serving notice?
- Article 43(3) makes it symmetrical: whichever party did not observe the notice period compensates the other, at the wage for the full period or the remaining part of it. So it is a deduction when the employee is short and an addition when the employer is.
